Shipping and Delivery Policy
This Policy has been prepared to inform visitors of the website and customers placing orders (“Buyer”) regarding the shipment and delivery of products ordered through https://www.helloornate.com (the “Site”), which belongs to Ozkoz Pharma Kozmetik Limited Şirketi (“OZKOZ”).
As a rule, OZKOZ is responsible for delivering the product in a sound and complete condition, in accordance with the specifications stated in the order. However, with regard to the delivery of products ordered and paid for by the Buyer, the relevant provisions set forth in the Distance Sales Agreement (“Agreement”) executed between OZKOZ and the Buyer shall remain valid.
Delivery Period
Following the sending of the order confirmation e-mail to the Buyer, the product shall be delivered to the cargo company as soon as possible. Provided that the product is in stock and payment has been completed, and without prejudice to cases where fulfillment of delivery becomes impossible, delivery shall be completed within 7 (seven) business days from the date on which the order is placed and/or approved by the Buyer.
Delivery to a Person/Address Other Than the Buyer
The Buyer may request delivery of the product to a person/institution other than themselves during the ordering process. In addition, a first-degree relative with a matching surname may also receive the order upon presenting valid identification. A signature is required from the person receiving the package at the delivery address.
If the contractual product is to be delivered to a person/institution other than the Buyer, OZKOZ shall not be held responsible for damages and expenses (such as additional shipping costs) arising from the absence of the designated recipient at the delivery address, refusal to accept delivery, or incorrect and/or incomplete delivery information provided by the Buyer.
If the invoice address specified by the Buyer differs from the delivery address, the Buyer agrees, declares, and undertakes to pay an additional shipping fee for delivery of the invoice to the relevant address.
Problems That May Occur During Delivery
As a rule, OZKOZ cannot be held responsible for failure to deliver the ordered product to the Buyer or to the person/institution authorized by the Buyer due to any issues encountered by the cargo company during delivery.
However, if the Buyer believes that the package and/or the product inside has been damaged during delivery (such as tearing, leakage, crushing, getting wet, etc.), the Buyer has the right to refuse delivery of the damaged package, request that the cargo officer prepare a report (Damage Assessment Report or Incident Report), and return the shipment.
If the cargo officer is of the opinion that the package or product is not damaged, the Buyer has the right to open the package in the presence of the cargo officer at the time of delivery, personally inspect the products, have the inspection conducted by the cargo officer, and document the situation with a written report.
The report must be prepared in two copies, one to remain with the Buyer and the other to be delivered to the cargo officer.
If the Buyer refuses the package and a report is prepared, the Buyer must notify OZKOZ immediately and at the latest within 1 (one) business day by sending an e-mail to info@ozkoz.com, attaching the copy of the report retained by the Buyer.
Upon completion of these procedures, OZKOZ shall initiate the necessary investigations regarding the package and ensure re-delivery as soon as possible.
In addition, if the person receiving the product believes that there is a delivery-related issue or defect with the product but is unable, for a justified reason, to have a report prepared as described above, they must immediately and no later than the day of delivery take photographs of the product and the package and send them via e-mail to info@ozkoz.com. In such case, OZKOZ shall contact the Buyer within 3 (three) business days regarding the delivery and return process.
If the package is accepted by the Buyer without any objection, and without any report being prepared or other evidence proving that the package and/or its contents were incomplete, defective, or different from what was ordered, it shall be deemed that the cargo company has fully performed its obligation and that OZKOZ has fulfilled its delivery obligation.
Termination of OZKOZ’s Delivery Obligation
OZKOZ’s delivery obligation shall terminate upon delivery of the ordered product to the Buyer or to the authorized person/institution at the address specified by the Buyer in the Agreement.
If, for any reason, the product price is not paid by the Buyer or the payment is canceled by the bank, OZKOZ shall be deemed released from its delivery obligation.
Nevertheless, the obligations of the Buyer and OZKOZ in the situations described above under the heading “Problems That May Occur During Delivery” are expressly stated, and in such cases, the rights of the Buyer and OZKOZ to make claims against each other and the cargo company are reserved.
Delivery Costs
As a rule, the shipping fee shall be paid by the Buyer and added to the total order amount. However, depending on the campaigns conducted by OZKOZ at the time of sale and/or announced on the Site, OZKOZ may choose not to charge the Buyer all or part of the shipping fee in accordance with the campaign conditions.
Additionally, for products returned by the Buyer through the exercise of the right of withdrawal, the shipping fee may be charged to the Buyer.
